ASTROGURUJI — TERMS & CONDITIONS

1. Earnings & Payment Cycle

The total earnings generated by the Astrologer during a month will be calculated at the end of that month. The payable amount will be processed and credited between the 1st to 7th of the following month.

2. Bank Account Requirement

• The Astrologer must provide a bank account in their own name for receiving payments.
• If the Astrologer does not have a bank account, they may open one and submit the details within 30 days.
• Until valid bank details are provided, the earnings will remain secure with the Company.

3. Payment Issues & Support

If the payment is not received between the 1st to 7th, the Astrologer must raise a support ticket. The Company team will verify the issue and ensure the payment is processed.

3A. Account Deactivation & Earnings Hold

In the event that an Astrologer's account is deactivated for any reason — including but not limited to policy violations, inactivity, verification issues, or administrative actions — any pending or unpaid earnings shall be placed on hold and will not be credited until the account is reviewed and reactivated by the Company.

The Company reserves the sole and absolute discretion to determine the status, review process, and reactivation of such accounts.

3B. Payment Delay & Processing Time

If the Astrologer's payment is not credited by the 7th of the month, the delay may be due to reasons including but not limited to:

• Technical errors
• Bank server or processing issues
• Incorrect or incomplete bank details
• Account mismatch
• Bank holidays or non-working days
• Any other unforeseen or third-party related issues

In such cases, the Astrologer agrees to allow 2 to 3 working days for resolution and processing of the payment. The Company shall not be held liable for delays caused by banking systems, payment gateways, or any third-party service providers.

4. Instant Withdrawal Policy

• Instant withdrawal is available only if the Astrologer's earnings are ₹20,000 or more.
• Even for instant withdrawals, processing time will be 24 to 48 hours.

5. Notice Period

If the Astrologer wishes to discontinue working with the Company, a 60-day notice period must be served.

6. Limited Non-Compete & Non-Solicitation

The Astrologer is free to work on other platforms. However, during the period of engagement with the Company and for 3 months after discontinuation, the Astrologer agrees:

• Not to directly solicit or divert the Company's users/customers to any other platform.
• Not to misuse or share any confidential data, including customer details, pricing, or business strategies.
• To maintain confidentiality of all sensitive information obtained while working with the Company.

This clause is intended to protect legitimate business interests and shall be interpreted in accordance with applicable Indian laws.

7. Pricing Policy

The Company reserves the right to change free chat rates or pricing structure at any time without prior notice.

8. General Terms

• The Company reserves the right to modify these Terms at any time.
• Continued use of the platform implies acceptance of the updated terms.

9. Code of Conduct & Legal Compliance

The Astrologer must maintain professional and ethical behavior while interacting with users. The Astrologer shall NOT:

• Engage in any inappropriate, abusive, or offensive communication.
• Provide false, misleading, or fear-based predictions.
• Make unnecessary or irrelevant predictions to exploit users.
• Conduct or promote gender prediction (sex determination) or any related activity prohibited under Indian law.

Any violation may result in:

• Immediate suspension or termination of the Astrologer's account.
• Withholding of pending payments (if required for investigation).
• Reporting to appropriate legal authorities.

Such actions may attract penalties under:

• The Information Technology Act, 2000.
• The Pre-Conception and Pre-Natal Diagnostic Techniques (PCPNDT) Act, 1994 — for gender prediction prohibition.

The Astrologer agrees that they are solely responsible for their conduct and any legal consequences arising from violations.

10. Strict Professional Boundary, Personal Relationship Prohibition & Liability Waiver

10.1 Professional Boundaries

The Astrologer shall strictly maintain professional boundaries and is prohibited from engaging in any personal, romantic, or intimate relationship with users, whether on or off the platform.

10.2 Personal Liability

Any such relationship shall be deemed a personal act at the sole risk and liability of the Astrologer, without any involvement of the Company.

10.3 Zero Company Liability

The Company shall have zero liability for any consequences arising out of such interactions, including but not limited to disputes, emotional distress, financial loss, reputational harm, or legal claims of any nature.

10.4 Intermediary Status

The Company qualifies as an intermediary under the Information Technology Act, 2000 and shall be entitled to safe harbour protection under Section 79 of the said Act and applicable intermediary guidelines.

10.5 Consequences of Violation

Any violation shall constitute a material breach of this Agreement, and the Company shall have the absolute right to:

• (a) Immediately suspend or permanently terminate the Astrologer's account.
• (b) Withhold pending payments during investigation.
• (c) Initiate appropriate civil and/or criminal legal proceedings.

10.6 Applicable Laws

Such conduct may attract legal consequences under applicable laws, including but not limited to:

Bharatiya Nyaya Sanhita, 2023:

• Section 318 – Cheating
• Section 351 – Criminal Intimidation
• Section 352 – Intentional Insult with intent to provoke breach of peace
• Section 75 – Sexual Harassment (where applicable)

Information Technology Act, 2000:

• Section 66E – Violation of Privacy
• Section 67 – Publishing or transmitting obscene content in electronic form

Consumer Protection Act, 2019:

Unfair Trade Practices & Misleading Services.

10.7 Indemnification

The Astrologer expressly agrees to indemnify, defend, and hold harmless the Company, its directors, employees, officers, and affiliates from and against any and all claims, demands, liabilities, damages, losses, costs, or legal proceedings (including attorney fees) arising out of or related to such conduct.

1. Nature of Services (No Guarantee Disclaimer)

• The services provided on this platform are based on astrology, numerology, tarot, and similar spiritual sciences, which are subjective in nature.
• All consultations, predictions, and guidance are provided for entertainment and guidance purposes only.
• The Company does not guarantee accuracy, completeness, or reliability of any predictions or advice.
• Any decisions made by the User based on the services are at their sole discretion and risk.

2. No Professional Advice

The services provided shall not be considered as professional advice, including but not limited to:

• Medical advice
• Legal advice
• Financial or investment advice

Users are strongly advised to consult qualified professionals for such matters.

3. Eligibility

• The User must be at least 18 years of age to use the platform.
• If a minor uses the platform, it shall be deemed that such use is under the supervision of a parent or legal guardian.

4. User Account & Responsibility

• The User is responsible for maintaining confidentiality of their account credentials.
• Any activity performed through the User's account shall be deemed to be the User's responsibility.

5. Payments, Wallet & Refund Policy

• All payments made on the platform are final and non-refundable, except in cases of: technical failure; service not delivered.
• Refunds, if applicable, shall be processed at the sole discretion of the Company.
• The Company shall not be responsible for payment failures due to third-party payment gateways.

6. Chat/Call Recording & Monitoring

• The Company reserves the right to monitor, record, and review chats or calls for quality assurance, training, and dispute resolution.
• By using the platform, the User provides consent for such monitoring.

7. User Conduct & Restrictions

The User agrees NOT to:

• Use abusive, offensive, or inappropriate language.
• Engage in illegal or prohibited activities.
• Request gender determination or any unlawful service (prohibited under Pre-Conception and Pre-Natal Diagnostic Techniques Act, 1994).
• Attempt to contact astrologers outside the platform.

Violation may result in account suspension or permanent ban.

8. Personal Interaction Disclaimer

The platform strictly discourages any personal, romantic, or off-platform relationship between Users and Astrologers. The Company shall not be responsible or liable for any personal relationship, communication, or dispute arising between Users and Astrologers.

9. Limitation of Liability

The Company shall not be liable for:

• Any decisions made by the User.
• Financial loss, emotional distress, or damages.
• Any indirect or consequential loss.

The maximum liability of the Company shall not exceed the amount paid by the User for the specific service.

10. Intermediary Role

The Company acts as a platform connecting Users and Astrologers and shall be treated as an intermediary under the Information Technology Act, 2000. The Company shall not be responsible for the conduct, advice, or communication of Astrologers.

11. Fraud & Misuse

Any fraudulent activity, chargeback abuse, or misuse of services may result in:

• Immediate account suspension.
• Legal action.

Such actions may attract liability under the Bharatiya Nyaya Sanhita, 2023.

12. Data Privacy

• User data shall be handled in accordance with the Company's Privacy Policy.
• The Company shall take reasonable measures to protect user data but does not guarantee absolute security.

13. Service Availability

• The Company does not guarantee uninterrupted or error-free service.
• Services may be affected due to technical issues or maintenance.

14. Force Majeure

The Company shall not be liable for failure or delay due to events beyond its control including:

• Natural disasters
• Internet failures
• Government restrictions

15. Dispute Resolution & Arbitration

• Any dispute shall first be resolved amicably within 30 days.
• If unresolved, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
• The seat of arbitration shall be Gwalior, Madhya Pradesh, and proceedings shall be in English.

16. Governing Law & Jurisdiction

• These Terms shall be governed by the laws of India.
• Courts at Gwalior, Madhya Pradesh shall have exclusive jurisdiction.

17. Modification of Terms

• The Company reserves the right to modify these Terms at any time.
• Continued use of the platform constitutes acceptance of updated Terms.

18. Declaration

By using the platform, the User confirms that they have read, understood, and agreed to these Terms & Conditions.
