Service Provider shall be considered to be an "Astrologer" if you have represented that you have a recognized Degree/Diploma/Certificate in the category you are registered as an Astrologer and register to be an Astrologer with the explicit purpose of providing your consultation to the Data Principal of the AstroGuruji Platform. The Data Principal and Astrologer shall collectively be deemed as "Users". For the purpose of this Privacy Policy the term Our Services may include services provided by Third party, AstroGuruji shall reserve all rights to determine and solely make decisions relating to any and all services provided by the platform. Please read this Terms and Condition carefully to understand how the website is going to use your information supplied by you to the Website.

This Terms and Condition is published in accordance with Section 43A of the Information Technology Act, 2000 read with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 as applicable, which requires publishing of the Terms and Condition for collection, use, storage, management, and transfer of sensitive personal data or information.

We implement industry-standard security measures adhering to data protection and establishing Privacy Policy to ensure the safe collection, use, storage, and transfer of your sensitive personal information. Users have rights to access, correct, or delete their personal data by contacting us, subject to applicable laws.

We provide clear disclaimers in all communications. stating that the predictions and advice provided through the platform are without guaranteed outcomes. AstroGuruji does not guarantee the accuracy of predictions, or the effectiveness of any services and all services are provided with full transparency, in line with the applicable laws.

PURPOSE AND USE OF DATA COLLECTION

By collecting this information, AstroGuruji aims to create a personalized user profile that can cater to your specific needs and preferences. However, if you choose not to provide your date of birth, you should cease to use the platform immediately.

If you wish to delete your entire AstroGuruji profile, you can find an option to "Delete My Account" Click on the profile option in the side menu, then navigate to settings. Select the option 'Delete Account' and follow the instruction to complete the account deletion procedure.

Users must also note that Personal information collected by AstroGuruji will be retained for as long as reasonable to fulfil the purposes outlined in this Privacy Policy, and to provide a smooth, quick and easy experience for users, or as required by law.

PROCESSING OF DATA COLLECTED

All the data Collected by us is stored in a secured manner using necessary encryption, as maybe mandated by the law in force in India, in situation where no encryption method is mandated by law in force in India, AstroGuruji shall reserve the right to exercise its sole discretion in manner and method of storing / processing / use of data. If the User disagrees with any of the clauses herein, the User shall immediately cease to use the platform.

PERSONAL IDENTIFIABLE INFORMATION

The information qualifies as personal in nature when the information collected identifies a specific end user or astrologer shall be deemed to fall within the ambit of Personal Identifiable Information (Hereinafter referred as "PII"). Such information would be collected by the website during the following actions:-

1. Creating an account / Registration data:

While accessing the Website, the User of the Website may be required to create an account. The PII which may be sought while creating an account shall include, but not limited to the Full name, Address, Telephone Number, Email-address, Gender, Location, Photograph, any other items of 'sensitive personal data or information" as such term is defined under the Information Technology (Reasonable Security Practices And Procedures And Sensitive Personal Data Of Information) Rules, 2011 enacted under the Information Technology Act, 2000, and any other detail required on the website during registration. It is hereby informed to all the Users that the e-mail address or phone number together with a password or OTP is used for the purpose of securing User's profile and for effective implementation of the personalized E-mail and SMS Services provided by the Website to the User. In the event that no registration is made by the User, the Website may not be able to provide any services due to non-availability of the personal identifiable information of the User.

2. Log Files, IP Address, Cookies and Other browsing data:

The website collects information that is stored by your browser on your computer's hard drive i.e. through cookies. It further automatically logs generic information about the user's computer connection to the Internet i.e. Session Data. For such information which is in public domain and accessible to all the Users and visitors of the Website, the User is advised to exercise its discretion before disclosing it as this information is susceptible to misuse.

3. Miscellaneous Activities:

The Website may collect any other information which may be mandatory to be disclosed and further may receive any other information via email or other method inclusive of contract with regard to specific services availed from the Website or any products bought from the Website, such information may not be made part of the User-Member's Profile but shall be used only for addressing the specific need or concern of the User.

4. Device Information:

We collect device specific information such as but not limited to unique device identifiers, and mobile network information. AstroGuruji may associate user device identifiers or phone numbers with your AstroGuruji account for as long as reasonable.

As part of the effective provision of the Services and quality control purposes, we may request reviews from you about Astrologer and other feedback and you agree and acknowledge that Astrologer may provide reviews about you to us. You consent to grant us the right to publish and/or otherwise use reviews provided by you. You must not knowingly provide false, inaccurate, or misleading information in respect of the reviews. Reviews will be used by us for quality control purposes and to determine whether Users and Service Professionals are appropriate users of the Platform. If we determine at our sole discretion that you are not an appropriate user, we reserve the right to cancel your registration and remove you from our Platform.

ASTROLOGICAL DATA

Data shall qualify as Astrological Data only if the data is related or co-related to date of birth, time of birth, place of birth and astrological history of the user. The said information collected by platform may extend but shall not be limited to consultation with Astrologer, generative charts, and other purposes. Astrological Data shall be pre-dominantly used for the purpose of consultation and may be retained for a period of 6 months.

SENSITIVE PERSONAL DATA OR INFORMATION

Sensitive Personal Data or Information (Hereinafter referred as "SPDI") is the data falling collected through Third Party Payment gateways associated with the website for the purpose of processing any financial transaction and any personal history shared during consultation with the astrologer. SPDI shall be collected by the website during the usage of the website, and the data collected by the website shall include but shall not be limited to Name of the User, Date of Birth of the user, Place of Birth of the User, Time of Birth and Primary Language. The data of the User may be consulted in the following circumstances: -

Booking a paid service/consultation: While booking a service or consultation through AstroGuruji, SPDI may be sought would include, but will not limited to the information as mentioned in Column 1(a), financial information inclusive of bank account information, credit card or debit card details or other payment instrument / method details through a secure third party gateway, IP (Internet protocol) Address and any other information that a User may provide during booking a paid service on the Website. Such information is kept highly confidential.

Purchase of Product: - While purchase of a product from AstroGuruji, SPDI shall be sought and User may be required to provide the following information Name, Gender, DOB, Birth Time, Birth Place, Primary Languages.

NON - PERSONAL IDENTIFIABLE INFORMATION

The information qualifies as non-personal in nature when the information collected does not identify a specific end user. Such information is collected when the user visits the Website, cookies, etc. and would include but not limited to the following:

  1. URL (Uniform Resource Locator) of the previous website visited by the User before visiting this website or the URL of the website the User visits after visiting this Website.
  2. Internet service provider / IP Address / Telecom service provider.
  3. Type of Browser used for accessing the website.
  4. Geographical Location

Such non-personal identifiable information is used by the Website for the purposes including but not limited to troubleshoot connection problems, administer the website, analyse trends, gather demographic information, frequency of visits to the website, average length of visits, pages viewed during a visit, compliance with applicable law, and cooperate with law enforcement activities, etc.

The information is used for improving the site content and performance and the website may share this information with Third Party Service Providers and Third Party Advertisers to measure the overall effectiveness of the website's online advertising, content, programming and for other Bonafide purpose as required.

The payment details are entered on the Payment Gateway's or Bank's page on a secured Secure Sockets Layer to ensure User's privacy & data integrity, none of the details of the User is retained by the payment gateway, unless expressly provided in their respective policy. USER'S CONSENT

Creating a user profile with AstroGuruji involves providing specific information. The mandatory details include your phone number for OTP (One-Time Password) verification, which is necessary to ensure the security and validity of the registration process. Your birth details, name are shared with independent consultants or astrologers you choose to interact with however your phone number is masked and not shared with them and phone number may also be used for the purpose of Astrologers connecting with you via phone call when you have requested to talk with them on the website. Your phone number will never be shared with the Astrologers directly; when you are contacted via phone call, it is only through our service, whereby you receive a phone call from the astrologer that you have chosen to consult with, with the website as the intermediary, so that your private phone number remains private, unknown, and unknowable to any third parties including Astrologers, and you are still able to use your phone to speak with them, as per your convenience. Additionally, you are required to provide your First Name, Last Name, and Date of Birth (DOB) and Astrological Data. This information will be stored and used in compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and for the purposes described in this policy.

We may share your Personal Data (including PII, contact details, birth details, and Astrological Data) with trusted third-party service providers, such as cloud hosting providers, payment gateways, and analytics tools. To enable you to record your questions and thoughts in your own voice as audio, we need to request access to your device's microphone. When you grant us this permission, it allows our app to capture the sound of your voice as audio and convert it into digital data that we can process. The recorded audio files are stored securely in compliance with our security standards and will be deleted after a reasonable period of time unless otherwise required for legal or regulatory purposes.

Any information shared during audio, video or text interactions, or any information shared not to the platform, but to the third party using the platform (such as Astrologers or other users) shall not fall under the ambit of information protected by this privacy policy, and AstroGuruji shall have no liability arising out of any consequences of sharing such information, or any responsibility whatsoever to safeguard, delete or control such information. If the users seek to revoke consent or remove data from AstroGuruji, kindly refer to the Clause 'Data security & retention'

DATA SECURITY & RETENTION

We implement and maintain robust "Reasonable Security Practices and Procedures" as defined under Rule 8 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, read with Section 8 of the Digital Personal Data Protection Act, 2023, to protect your Personal Data including PII, and other data from unauthorized access, alteration, disclosure, or destruction. These measures include, without limitation: (i) end-to-end SSL/TLS encryption (minimum AES-256 standard) for data in transit across the Website and Our service (ii) restricted access protocols enforced via role-based access controls, multi-factor authentication, and just-in-time privileges, ensuring only authorized personnel process data on a need-to-know basis (iii) regular vulnerability assessments, penetration testing (annually by CERT-In empanelled auditors), and compliance with ISO/IEC 27001:2022 standards (iv) pseudonymization of sensitive fields like phone numbers, or other data using hash and (v) incident response protocols mandating breach notification to you and the Data Protection Board within 72 hours (per DPDP rules) or 6 hours to CERT-In (per IT Rules). Specific retention periods include: (i) account and consultation data for the duration of your active user profile plus 12 months post-termination (to handle disputes or refunds); (ii) financial/transaction data for 7 years (Income Tax Act, 1961); (iii) audit/security logs for 5 years (IT Act, 2000); and (iv) Astrological Data/forecasts until erasure request or service cessation. Upon expiry of the retention period or upon your valid Right to Erasure request (processed within 30 days per Section 12, DPDP Act), data is deleted using secure methods or anonymized to prevent reconstruction, except where legal holds apply. To revoke any optional consent or remove your data from AstroGuruji you may reach out to our team. Deletion confirmations are provided via email, and we notify third-party processors to mirror such actions under their Data Processing Agreements.

PROFILE DELETION

The platform ensures User's privacy and provides for a reasonable procedure to the User, to Delete the profile the User shall click on the setting option in the side menu then follow the instructions as provided in the menu then complete the account deletion process. The Platform may retain the data as may be required in compliance with the law in force in India, thereafter the data is removed or anonymised once the purpose provided by the law or as mentioned in the Privacy Policy and Terms and Conditions are fulfilled within 30 days.
