AstroGuruji does not guarantee the accuracy of predictions, or the effectiveness of any services and all services are provided with full transparency, in line with the applicable laws.

By clicking "I Agree," or by continuing to use the Platform, you provide your express, informed, and unconditional consent to the collection and processing of your data as described herein. If you do not agree, you must immediately cease all access to the Platform.

By using this website, you agree that you are over the age of 18 years and are allowed to enter into a legally binding and enforceable contract under Indian Contract Act, 1872. The Website would not be held responsible for any misuse that may occur by virtue of any person including a minor using the services provided through the Website. You are however allowed to ask questions related to minors in your family as per the terms and conditions outlined herewith in this policy.

For the User to avail the services, the User will be directed to Register as a Member on the Website whereby You (User) agree to provide update, current and accurate information while filling up the sign-in form. All information that you fill and provide to the Website and all updates thereto are referred to in these Terms of Usage as "Registration Data".

An account could be created by you through the Website ID (Your Phone Number) and password (OTP) or other log-in ID and password which can include a facebook, gmail or any other valid email ID. The User while creating an account hereby represents and warrants that all the information provided by the User is current, accurate and complete and that the User will maintain the accuracy and keep the information updated from time to time. Use of another User's account information for availing the services is expressly prohibited. If in case it is found that the information so supplied on the Website is inaccurate, incomplete, untrue and not current, the Website has the right to suspend or terminate the User's account and restrict/refuse the use of the Website by such User in future.

The right to use this Website is personal to the User and is not transferable to any other person or entity. The User would be responsible for protecting the confidentiality of User's passwords and other information required for the purposes of registration. The User would be fully responsible for all the activities that occur under the User's account with the Website. The Website cannot and will not be liable for any loss or damage arising from the User's failure to maintain secrecy and confidentiality. The User shall notify the Website immediately if they become aware of any unauthorized use of their Account(s) or breach of any security. The User must log out from its account at the end of the session.

The User while availing any service shall be informed whether the service so rendered is personal to the Website or is available from a Third party. The Website shall have no control or monitoring on the information disseminated to any third party via the Website.

The User agrees, understands and confirms that his/her personal data including without limitation to details relating to debit card/credit card transmitted over the Internet may be susceptible to misuse, hacking, theft and/or fraud and that the Website or the Payment Service Provider(s) have no control over such matters.

The Website does not permit the use of the Services by any User under the following conditions: -

• If the User is a resident of any jurisdiction that may prohibit the use of the Services rendered by the Website.
• If the User is a resident of any State/Country that prohibits by way of law, regulation, treaty or administrative act for entering into trade relations or/and due to any religious practices.
• If the User has created multiple accounts using various mobile numbers. The User may not have more than one active account with the Website.

AstroGuruji is not liable for any nature being, direct or indirect damages arising from your use of the platform or interactions with Experts. You agree to indemnify AstroGuruji against any claims brought by an Expert related to your payments or interactions.

The User (inclusive of the Service Provider and the Member Customer) under an obligation not to violate the privacy policy, terms and conditions and any other terms as defined on the Website. The User represents that he is an individual and not a corporation or other legal business entity. The rights to use the Website's services is personal to the User. The User shall while using the Website and engaged in any form of communication on any of the forums inclusive of the products listed on the Website shall not violate the terms and conditions which are inclusive of: -

1. The User shall not post, publish or transmit any messages that is false, misleading, defamatory, harmful, threatening, abusive, harassing, defamatory, invades another's privacy, offensive, promotes racism, hatred or harm against any individual or group or religion or caste, infringes another's rights including any intellectual property rights or copyright or trademark, violates or encourages any conduct that would violate any applicable law or regulation or would give rise to civil liability.
2. The User shall not upload or post or otherwise make available any content that User do not have a right to make available, under any law or under contractual or fiduciary relationships.
3. The User shall not upload or post or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party. The User may, however, post excerpts of copyrighted material so long as they adhere to Fair Use guidelines.
4. The User agrees to treat every person using, or connected via this platform equally with respect, without bias or discrimination based on race, color, religion, gender, nationality, age, disability, sexual orientation, or any other protected characteristic. The User shall ensure that all services, support, and interactions are delivered in a fair, consistent, and impartial manner to all customers, in compliance with applicable laws and regulations. Any deviation from this obligation shall be considered a material breach of this Agreement.
5. The User shall not collect screen names and email addresses of members who are registered on the Website for purposes of advertisement, solicitation or spam.
6. The User shall not send unsolicited email, junk mail, spam, or chain letters, or promotions or advertisements for products or services.
7. The User shall not upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another's computer.
8. The User shall not engage in any activity that interferes with or disrupts access to the Website.
9. The User shall not attempt to gain unauthorized access to any portion or feature of the Website, any other systems or networks connected to the Website, to any of the services offered on or through the Website, by hacking, password mining or any other illegitimate means.
10. The User shall not violate any applicable laws or regulations for the time being in force within or outside India. The use and continuous use of the Website is subject to but not limited to using the services for personal use.
11. The User shall not resell or make any commercial use of the Services without the express written consent from the Website.
12. The User shall not violate these Terms of Usage including but not limited to any applicable Additional terms of the Website contained herein or elsewhere.
13. The User will not (a) reproduce, modify, make derivative works of, reverse engineer, decompile, or disassemble the Platform or material found on the Platform, (b) modify copyright or other proprietary rights notices of Company or its licensors in or accompanying the Platform, (c) make the Platform available in any manner to any third party for use in the third party's business operations, (d) access or use (or permit third parties to access or use) the Platform in order to build or support any product or services competitive with the Platform, or (e) inaccurately or falsely represent yourself to the Company. Violation of this clause shall render deactivation of User's profile axiomatically, and shall further make User liable to pay fine of Rs. 51,000/- to AstroGuruJi.
14. The User by becoming a Registered member of the Website agrees to the following situations, which list is not exhaustive and may include services incidental to the below mentioned: -
15. The user agrees to receive communication through the app/website through email/SMS or any other communication medium including though WhatsApp Business Messages in regards to the usage of the app/website.
16. The User agrees not to transmit via the Website any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature.
17. The User not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national or international law or regulation. Attempts to gain unauthorized access to other computer systems are prohibited.
18. The User shall not interfere with any other members' use or enjoyment of the Website or Services.
19. The User is under an obligation to report any misuse or abuse of the Site. If you notice any abuse or misuse of the Site or anything which is in violation of this Agreement, you shall forthwith report such violation to Website by writing to Customer Care. On receipt of such complaint, Website may investigate such complaint and if necessary, may terminate the membership of the Member responsible for such violation abuse or misuse without any refund of the subscription fee.
20. The Astrologer regardless of their professional and educational training, Astrologer agrees to never engage in the practice of medicine through the Platform, including, without exception, diagnosing medical conditions and prescribing or dispensing any medications.
21. The Astrologer agrees to not use the Platform to solicit clients for any services outside of the Platform. If the Astrologer interacts with a user outside the Platform (i.e., via LinkedIn, Instagram, Facebook, FaceTime, WhatsApp, Skype, phone, email, in person, etc.) Company may terminate the user immediately and/or withhold any payments owed or due to Astrologer at Company's sole discretion. The Astrologer agrees to not use the Platform for personal brand building and publicize their presence on the Platform through any online/offline media.
22. The Astrologer agrees that they are prohibited from providing services to a minor.

Under the Digital Personal Data Protection Act, 2023, as a Data Principal, you hold key rights over your Personal Data processed by us as Data Fiduciary. You may request, free of charge, a summary of data we hold about you, which we will provide user within 30 days via email or secure download. You may request us to rectify any inaccurate or incomplete data, such as birth details or contact info and we will verify and update within reasonable time, notifying any third-party recipients. In addition to aforementioned the User may request erasure of their data and or deletion of your account. In pursuance of the applicable law data might be retained. Submit requests to [____] with OTP verification; we process within 30 to 45 days, confirming destruction or anonymization. The User may withdraw consent at any time, effective prospectively, which may terminate services like consultations or forecasts—email us to exercise this, and we'll halt processing accordingly while honoring legal holds.

The Astrologer will not provide to Users any services other than agreed upon Services with the Company. Violation of this clause will attract the deactivation of User's profile without any warning issued and a fine in Compliance with the prevalent penal laws team at AstroGuruji.

The user shall only provide genuine feedback about the Service Provider and shall own responsibility of the same, in case of a fake review or feedback or false feedback, the Company shall reserve the right to review and take appropriate action on such unfair negative feedback which may be baseless and without any evidence of unfit services. Any false complaint made by a Member shall make such Member liable for termination of his/her membership without any refund of the subscription fee.

The User acknowledges and agrees that the Platform is being provided for use "as is" and on an "as available" basis without warranty of any kind, express, implied, or statutory, and therefore he/she will not have any plea, claim, or demand towards the Company in relation to the Platform's Users, members, properties, limitations, or compatibility with the User's needs. The User shall not have any plea, claim, or demand against the Company in respect to any services he/she decides to provide in connection with the use of the Platform. To the fullest extent of the law, the Company expressly disclaims all warranties of any kind, whether expressed or implied.

AstroGuruji prohibits discrimination against Service Providers basis race, religion, caste, national origin, disability, sexual orientation, sex, marital status, gender identity, age, or any other characteristic protected under applicable law. Discriminatory behaviour, including but not limited to refusal to accept services from Service Providers based on these characteristics, will not be tolerated. We request that you treat all Service Providers with respect and courtesy. You are expected to engage with Service Providers in a civil and respectful manner.

The Website reserves the right to withdraw its services/ terminate access or take legal action against any customer who is found to be unreasonable or abusive during their conversation or engaging in harassment, hate speech, illegal activities, or violating community standards set by the platform with the Service Provider inclusive of Service Provider regardless of any reason.

In the event that any Service Provider behaves in a discourteous, abusive, or inappropriate manner, or if their conduct violates any laws, you are required to report the incident to support@AstroGuruji.com within 48 hours. AstroGuruji will take reasonable action to address the issue in accordance with our policies.

While the Website shall take all steps to resolve any situation that is in violation of the above obligations arises, however if the situation is not controllable, the Website reserves its right to send a written warning henceforth. Such violations, if repeated by the User, shall lead to a total ban for transacting on the platform by such User. If any balance is present in the wallet of the User, the same shall be refunded subject to the other charges that may be applicable for such violations.

All content made available on the AstroGuruji platform including text, images, audio, video, software, visuals, promotional material, and third-party advertisements is protected under applicable intellectual property laws, including copyrights, trademarks, and patents.

Access to our Website shall only grant you a limited license to use our information. Users are prohibited from reproducing, distributing, modifying, or publicly displaying any content from the platform unless they have received formal written permission from AstroGuruji or the rightful content owner.

Some visual or design elements (such as images or icons) may be sourced from publicly available platforms like Google Images. AstroGuruji does not claim ownership of such content and disclaims liability for any copyright issues that may arise from their use.

You are authorised to save the data from the Website to any device for your personal use as long as you don't remove or alter any copyright symbols, trademarks, or other proprietary material. You are not permitted to use our information for any other reason than what is stated above. You acknowledge that any unauthorised use of the confidential information on the Website is a violation of our intellectual property rights, for which you agree to hold us harmless.

Except for any third-party elements that are expressly designated as such, We declare that We are the exclusive owner of all the contents displayed on the Website, including all graphics, logos, sound recordings, and software. The law that is in effect in India shall apply to any infringement of our intellectual property rights. The license to access and use our Services does not include the right to copy or reproduce our information on any other platform or medium, without our prior written consent.

A User's right to access our Website shall not be deemed to grant a license for such User to use our Intellectual Property Rights.

At AstroGuruji we have customised pricing according to the services rendered by us. The details are provided to you beforehand according to the effort, efficiency and the output of the service. Typically, the range of transactions on our Android and iOS applications and shall vary from contingent on the plan/product opted by the user.

Some of our services can be utilised for fixed durations. In such cases, it is clearly mentioned within the description of these services. The period of usage in these cases vary from ____.

We are committed to offering you the best possible prices. We will be glad to meet our competitor's pricing if you ever find a service that we offer, in the similar interest and providing same professionalism and features, available from a similar service provider.

If a service that you have purchased is reduced in price within one weeks of your booking date, we will not be able to adjust the sale price for you. Please note that we cannot make sale adjustment. If you have booked a slot for a date, generally, we cannot reschedule the slot to another date. This will result in the cancellation of the booking/order(s). Please refer cancellation policies for more details.

Pricing for products, services and offers is dynamic, adjusting based on availability, astrologer demand, peak hours, and other factors, displayed prices are real-time but subject to change without notice. No retroactive adjustments shall be applicable for such price drops or hikes. Rescheduling booked slots incurs cancellation fees per policy.

We work hard to ensure the accuracy of pricing. Despite our efforts, pricing errors may still occur. If a service's price is higher than the price displayed, we will cancel your booking and notify you of the cancellation.

The User is under an obligation to provide his banking information as and when required. For that purpose, the obligation of the User are:-

1. The User agrees that the debit/credit card details provided by him/her for use of the aforesaid Service(s) must be correct and accurate and that the User shall not use a debit/credit card, that is not lawfully owned by him/her or the use of which is not authorized by the lawful owner thereof. The User further agrees and undertakes to provide correct and valid debit/credit card details.
2. The User may pay the fees required, to the Website by using a debit/credit card or through online banking account. The User warrants, agrees and confirms that when he/she initiates a payment transaction and/or issues an online payment instruction and provides his/her card/bank details:
3. The User is fully and lawfully entitled to use such credit/debit card, bank account for such transactions;
4. The User is responsible to ensure that the card/bank account details provided by him/her are accurate;
5. The User is responsible to ensure sufficient credit is available on the nominated card/bank account at the time of making the payment to permit the payment of the dues payable or the bill(s) selected by the User inclusive of the applicable Fee.
6. The User further agrees that if any part of these Terms of Usage are determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms of Usage shall continue in effect.
7. No refund shall be processed on the order of any reports under any circumstances if the order has reached the "processing" (Assigned to an Astrologer) stage. The risk and liability of placing order in a haste and careless manner totally lies with the User and the Website is not responsible for any refund once the processing stage has started.
8. No refund shall be processed once the Order has been placed and executed. However, if the User intends to cancel a successfully placed order before execution, the User is required to contact the customer care team within 1 (one) hour of making the payment, whereafter it is totally at the discretion of the Website whether to issue refund.
9. Any technical delay or glitch reported in the Website during the processing of the request which includes generating reports by the service provider i.e. Astrologer shall not be eligible for claiming refund. The User agrees that the timelines are approximate and all essentials steps would be taken to adhere to the timelines as displayed.
10. No refund shall be processed for the reason that in-correct information or data has been provided by You. The User agrees to be careful while providing any information to the Website and must re-check the information filled before clicking on "Submit". The User can request for change in the in-correct information or data entered provided, the request for such change has been made with the customer care within 1 (one hour) of execution of the service rendered by the service provider.
11. No refund shall be processed for return of any damaged product. The User undertakes and agrees that by ordering any product as displayed on the Website, the Registered User shall be fully responsible for any damaged caused to the product, post its delivery. For orders made via "Cash on Delivery" method of payment, the User shall be charged for the cost of the product as displayed by the Website and the shipping/custom/courier charges as applicable, if the product is returned.

You agree that the display picture for the products listed for purchase by the User are for reference purpose only and the Website will try to deliver the product ordered in an as-is condition as displayed on the Website. The User is advised to exercise discretion in such case and no refund shall be issued on such grounds.

The services offered and the products sold are strictly not meant to replace any philosophical, emotional or medical treatment. The Website holds no responsibility or liability about the reality or reliability of the astrological effects on the human physiology, by the gems represented and sold on the Website. The placing of order for buying such products or taking the services is solely on the discretion and will of the User and the Website does not have any responsibility upon the products sold. The User is advised to exercise discretion in such case and no refund shall be issued on such grounds.

No refund shall be processed for providing a wrong contact number for the purpose of availing the "Call with Astrologer" feature. The User once opted for this feature is advised to keep the Contact Number in full coverage area and must answer the call when received. No refund shall be processed for any call which gets connected.

The refunds, if any, shall be processed after deduction of the transaction charges levied by the Bank and/or the Payment Gateway, to & fro cost of the shipping and/or courier charges (With regard to purchase of a product listed on the Website), customs duty (if levied) and/or any other charges that may have been incurred by the Website during processing and/or delivering the service, as applicable.

In case the Website or Payment gateway's webpage, that is linked to the Website, is experiencing any server related issues like 'slow down' or 'failure' or 'session timeout', the User shall, before initiating the second payment, check whether his/her Bank Account has been debited or not and accordingly resort to one of the following options:

1. In case the Bank Account appears to be debited, ensure that you do not make the payment twice and immediately thereafter contact the Website via customer care to confirm payment.
2. In case the Bank Account is not debited, the User may initiate a fresh transaction to make payment.

However, refund for multiple payment, if any, even after the above precaution against the same order shall be refunded in full without deduction of the transaction charges as mentioned above. The Website shall only retain the cost of one single order as intended to be placed by the User.

If there are orders that the Website is unable to accept and must cancel, the Website at its sole discretion, reserves the right to refuse or cancel any order for any reason whatsoever. Some situations may result in the order being cancelled and include, without limitation, non-availability of the service, inaccuracy, error in pricing information or other problems as identified. If the User's order is cancelled after charges being paid against the said service, the said amount paid for booking shall be refunded.

We partner with trusted third-party logistics providers to ensure timely and secure deliveries across India and to selected international destinations. The processing time of the order is contingent on the nature and availability of the product/services. All the orders are attempted to processed within 1 to 2 business days, and orders area usually dispatched within 24 to 48 Hours after processing. The delivery time may vary from location to location.

In rare circumstances the deliveries might be delayed due to:

1. Weather conditions or natural disasters

3. Courier partner issues

AstroGuruji disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Except where explicitly specified, AstroGuruji makes no representations or warranties that:

1. The Website or App will be continuously available without interruption or free of errors.
2. The information presented is complete, accurate, non-misleading, or true in every respect.
3. The servers, systems, content, software, or services provided via the Website or App are free from viruses, malware, or other harmful components.
4. Any advice, prediction, or service provided constitutes legal, medical, or professional advice.
5. Any errors or defects will be corrected.
6. The use of the Website or App will meet your expectations or requirements.
7. The Website shall be liable for loss, misuse, alteration, or unavailability of User information.
8. The outcomes of astrological or spiritual services will be accurate, effective, or reliable.

Astrological counselling provided through AstroGuruji is based on the individual knowledge, experience, and interpretation of astrologers and service providers, and therefore, advice may vary from one provider to another. The Website does not guarantee the accuracy or efficacy of any recommendation made by the astrologers, including the use of gemstones, yantras, mantras, rituals, or other remedies.

Every User and Registered Member is solely responsible for fully and truthfully disclosing their emotional, mental, and physical condition to the astrologer to enable them to provide informed guidance. Any decision taken by a User based on such advice is done entirely at their own risk.

The Website may, in whole or in part, without informing the User, modify, discontinue, change or alter the services ordered or the Account of the User registered with the Website. The Website may or may not issue notice or provide any reason for such action taken by the Website.

Violation of any conditions mentioned in this Terms of Usage shall lead to immediate cancellation of the Registration of the User, if registered with the Website. The Website reserves right to terminate and initiate action immediately, if:

• The Website is not able to verify and authenticate the Registration data or any other relevant information provided by the User.
• The Website believes that the actions of the User may cause legal liability for the Website, other Users or any service provider linked with the Website.
• The Website believes that the User has provided the Website with false and misleading Registration Data or there is interference with the other Users or the administration of the services, or have violated the privacy policy as listed by the Website.

With regards to the Service Provider, you understand and agree that your relationship with the Website is limited to being a member and you act exclusively on your own behalf and for your own benefit.

No refund shall be processed on the order of any reports under any circumstances if the order has reached the "processing" (Assigned to an Service Provider) stage. The risk and liability of placing order in a haste and careless manner totally lies with the User and the Website is not responsible for any refund once the processing stage has started.

Refunds are not provided once an order for astrological services has been processed and delivered. Any requests for refunds must be made within 24 hours of service completion, subject to review by AstroGuruji's operations team. AstroGuruji reserves the right to approve or deny refunds based on the nature of the issue and compliance with these terms. However, if the User intends to cancel a successfully placed order before execution, the User is required to contact the customer care team within 1 (one) hour of making the payment, whereafter it is totally at the discretion of the Website whether to issue refund.

Any technical delay or glitch reported on the Website during the processing of the request which includes generating reports by the service provider i.e. Service Provider shall not be eligible for claiming refund. The User agrees that the timelines are approximate and all essentials steps would be taken to adhere to the timelines as displayed.

No refund shall be processed for the reason that in-correct information or data has been provided by You. The User agrees to be careful while providing any information to the Website and must re-check the information filled before clicking on "Submit". The User can request for change in the in-correct information or data entered provided, the request for such change has been made with the customer care within 1 (one hour) of execution of the service rendered by the service provider.

No refund shall be processed for return of any damaged product. The User undertakes and agrees that by ordering any product as displayed on the Website, the Registered User shall be fully responsible for any damaged caused to the product, post its delivery. For orders made via "Cash on Delivery" method of payment, the User shall be charged for the cost of the product as displayed by the Website and the shipping/custom/courier charges as applicable, if the product is returned.

Refund on pro-rata basis may be considered for any delay in the activation of the subscription services and any damage that may be caused to the product while in transit shall be dealt by the Website and its agencies. On successful verification, if refund is required, it will be made within 10 business days.

In case the Website or Payment gateway's webpage, that is linked to the Website, is experiencing any server related issues like 'slow down' or 'failure' or 'session timeout', the User shall, before initiating the second payment, check whether his/her Bank Account has been debited or not and accordingly resort to one of the following options: In case the Bank Account appears to be debited, ensure that you do not make the payment twice and immediately thereafter contact the Website via customer care to confirm payment. In case the Bank Account is not debited, the User may initiate a fresh transaction to make payment.

However, refund for multiple payment, if any, even after the above precaution against the same order shall be refunded in full without deduction of the transaction charges as mentioned above. The Website shall only retain the cost of one single order as intended to be placed by the User.

If there are orders that the Website is unable to accept and must cancel, the Website at its sole discretion, reserves the right to refuse or cancel any order for any reason whatsoever. Some situations may result in the order being cancelled and include, without limitation, non-availability of the service, inaccuracy, error in pricing information or other problems as identified. If the User's order is cancelled after charges being paid against the said service, the said amount paid for booking shall be refunded.

By requesting for refund, user is agreeing to provide AstroGuruji's quality audit team permission to access the chat/call recording of the consultation for which refund has been requested, in order to determine whether the case is eligible for refund or not.

AstroGuruji quality audit team, at best effort basis, provide partial/full refunds to the users in their AstroGuruji wallet wherever consultant's quality parameters are not satisfied. It can take upto 72 hours to analyse and refund the amount back to AstroGuruji wallet.

Note: All refunds will be credited to user's AstroGuruji wallet.

Refunds will only be considered in the following cases:

• Network issue due to which chat/call was affected in between or there was a weak signal, background noise, inaudible consultant etc during the video/normal call sessions
• Consultant is unable to respond fluently in the language mentioned in their profile
• Consultant is taking inordinately long enough to respond back to the user
• Consultant has responded back in irrelevant or inappropriate response to the query asked by the user

Please Note: No refund will be given in case of lack of accuracy of any consultation. AstroGuruji takes no responsibility for factual accuracy on any consultations.

Any dispute arising from these Privacy Policy or Terms of Usage, including scope and applicability, shall be resolved by arbitration in Ujjain, India, under the Arbitration and Conciliation Act, 1996, before a mutually appointed sole arbitrator. Arbitration proceedings will be in English, and the award will be final and binding.

Notwithstanding the above, either party may seek interim relief in the courts of Ujjain to protect its rights pending arbitration. These Terms are governed by the laws of India, and the parties submit to the exclusive jurisdiction of Ujjain, Madhya Pradesh, Courts for such proceedings.

Any dispute, claim or controversy arising out of or relating to this Terms of Usage including the determination of the scope or applicability of this Terms of Usage to arbitrate, or your use of the Application or information to which it gives access, shall be determined by arbitration in India, before a sole arbitrator mutually appointed by Members and Website. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Ujjain. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute.

Notwithstanding the foregoing, either party has the right to seek any interim or preliminary relief from a court of competent jurisdiction in Ujjain in order to protect the rights of such party pending the completion of any arbitration hereunder, and both parties agree to submit to the exclusive jurisdiction of the courts of India and venue in Ujjain for any such proceeding. If either party files an action contrary to this provision, the other party may recover attorneys' fees and costs up to One Lakh Rupees INR.

These Terms of Usage shall be governed by and construed in accordance with the laws of India without giving effect to any choice of law and principles that would require the application of the laws of a different state. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms of Usage or Privacy Policy to be unenforceable or invalid, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law, and the remainder of the Terms of Usage or Privacy Policy, as applicable, will continue in full force and effect. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. Any waiver of any provision of the Terms of Usage shall be effective only if in writing and signed by AstroGuruji. These Terms of Usage constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.

These Terms of Usage and your use of the Services will be interpreted in accordance with the laws of India excluding its rules on conflicts of laws. The parties agree to submit any dispute arising under these Terms of Usage to the jurisdiction of a court located in Ujjain for any actions for which the parties retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
